Website Terms of Use

These Website Terms of Use (“Terms”) govern your use of the public websites operated by Uva Software, LLC (“Uva Software”, “we”), including www.scanii.com, docs.scanii.com and related sites (the “Sites”). By using the Sites you agree to these Terms. Use of the Scanii service, its API and its web portal is governed by our Terms of Service (https://docs.scanii.com/article/143-terms-of-service) and not by these Terms.

1.   Content and license. The Sites and their content, including text, documentation, code samples, graphics, logos and trademarks (“Content”), are owned by Uva Software or its licensors and protected by intellectual property laws. You may view, download and print Content for your own use in evaluating or using Scanii, and link to any page of the Sites. Code samples in our documentation may be used in your own software. You may not otherwise reproduce, republish, sell or modify Content, remove proprietary notices, or use our name or logos in a way that suggests endorsement, without our written permission.

2.   Acceptable use. You will not use the Sites in violation of applicable law; attempt to gain unauthorized access to the Sites or their systems; interfere with their operation, including by automated requests that exceed what a person browsing would generate; or scrape or harvest Content or personal information. Vulnerability research is welcome under our disclosure program (https://docs.scanii.com/article/131-does-scanii-have-a-security-vulnerability-disclosure-program).

3.   Documentation and accuracy. We work to keep our documentation accurate and current, but the Sites are provided “as is” and “as available”, without warranty of any kind, express or implied, including as to accuracy, completeness, availability or fitness for a particular purpose. Documentation does not form part of the Terms of Service except where the Terms of Service say so.

4.   Third-party links. The Sites may link to third-party websites and services that we do not control. We are not responsible for their content or practices, and a link is not an endorsement.

5.   Privacy. Our Privacy Policy (https://docs.scanii.com/article/142-privacy-policy) describes how we handle personal data collected through the Sites and is incorporated into these Terms by reference.

6.   Limitation of liability. To the fullest extent permitted by law, Uva Software will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to the Sites or these Terms, however caused. Our total liability for any claim relating to the Sites is limited to one hundred U.S. dollars (USD 100). Nothing in these Terms limits liability that cannot be limited by law.

7.   Changes and termination. We may change the Sites or these Terms at any time by posting the updated version with a revised “Last updated” date; your continued use of the Sites after a change constitutes acceptance. We may suspend or block access to the Sites for any user who violates these Terms.

8.   Governing law and disputes. These Terms are governed by the laws of the State of Indiana and the United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Sites or these Terms will be brought exclusively in the state or federal courts located in Hamilton County, Indiana, and you consent to their jurisdiction. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

9.   General. If any provision of these Terms is held unenforceable, the remainder continues in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Uva Software regarding the Sites. Nothing in these Terms creates any agency, partnership or joint venture, or any rights for third parties.
